Website Use
You may use this website for lawful purposes only. You agree not to:
- Submit false, misleading, or fraudulent information through our forms
- Use automated tools to scrape, copy, or overload the site
- Attempt to access areas of the site you are not authorized to use
- Upload harmful code or interfere with site security
- Copy our content, photos, or branding for your own commercial use
We may restrict or block access to anyone who misuses the site.
Free Estimates and Quotes
Requesting an estimate through our website, phone, or text does not create a contract. It simply starts a conversation.
- Estimates are based on the property conditions we observe at the time of the visit and the scope you describe
- Quoted pricing is valid for 30 days unless we state otherwise in writing
- Work begins only after you approve the scope and pricing
- If conditions change after we start, such as buried debris, rock, hidden stumps, poor soil, drainage issues, or a change you request, we will stop, explain the situation, and provide updated pricing before continuing
- Verbal approvals for added work are binding once the work is performed
Scheduling, Access, and Weather
Outdoor work depends on weather and ground conditions. Rain, snow, frozen ground, high winds, and equipment issues can shift a schedule.
- We will keep you updated if your date needs to move
- You agree to provide safe, clear access to the work area on the scheduled day
- Please remove vehicles, pets, patio furniture, toys, and personal items from the work zone before we arrive
- If our crew arrives and cannot access the site, a return trip may be billed
- Snow removal timing during winter events depends on storm severity, plow routes, and safety. We do not guarantee a specific clearing time
Property Conditions and Utilities
Before any digging, grading, land clearing, or excavation work, we will arrange for public utility marking through Miss Utility in Maryland as required by law.
You are responsible for identifying and pointing out anything that is not covered by public utility marking, including:
- Private irrigation and sprinkler lines
- Invisible pet fences
- Septic systems, tanks, and drain fields
- Private electrical, gas, or water lines to sheds, pools, garages, and outbuildings
- Landscape lighting wiring
- Property line locations and easements
We are not responsible for damage to unmarked private lines or structures we were not told about. You also confirm that you own the property or have permission from the owner to authorize the work, and that the work complies with any HOA rules, county permit requirements, or local ordinances that apply.
Pricing and Payment
- Pricing is provided in writing before work begins
- A deposit may be required on larger landscaping, hardscaping, land clearing, or grading projects
- Final payment is due upon completion unless we agree to different terms in writing
- Accepted payment methods will be listed on your estimate or invoice
- Late payments may be subject to a late fee and collection costs allowed under Maryland law
- Materials remain our property until paid for in full
Prices for mulch, stone, sod, pavers, topsoil, and gravel can change with supplier costs. If material pricing changes significantly between your quote and your start date, we will notify you before ordering.
Cancellations and Rescheduling
- Please give us at least 48 hours notice to cancel or reschedule a project
- Cancellations made after materials have been ordered or delivered may be subject to restocking or delivery costs
- Deposits on custom hardscaping and large projects may be non refundable once materials are purchased or equipment is scheduled
- We may cancel or reschedule for weather, safety, equipment failure, or unsafe site conditions with no penalty to either side
Workmanship and Plant Material
We stand behind our work. If something we installed fails because of our workmanship, tell us and we will make it right.
Please understand the natural limits:
- Living material such as sod, seed, plants, shrubs, and trees depends heavily on watering, sunlight, soil, drainage, pests, and weather after we leave. Because we cannot control those conditions, we do not warranty plant survival unless we agree to a specific warranty in writing
- Watering after installation is the property owner’s responsibility
- Mulch, decorative stone, and topsoil settle and fade naturally over time
- Pavers and hardscape surfaces can shift with freeze and thaw cycles typical of Maryland winters
- Drainage improvements reduce water problems but cannot guarantee elimination of all standing water in extreme rainfall
Manufacturer warranties on materials such as pavers and retaining wall block pass through directly to you.
Tree Work and Land Clearing
Tree removal, tree clearing, storm cleanup, and land clearing carry inherent risk.
- Some lawn damage, ruts, and soil compaction can happen when equipment operates on soft ground, particularly during wet seasons and storm cleanup
- Stump grinding is a separate service unless it is listed on your estimate
- Debris hauling and disposal is included only when stated on your estimate
- Trees that are dead, diseased, storm damaged, or structurally compromised can behave unpredictably. We take every reasonable safety precaution, but we cannot guarantee zero incidental impact to surrounding turf, beds, or landscaping
Photos and Marketing
We photograph completed projects for our website portfolio, social media, and marketing. These photos focus on the property work itself, not on people, and we do not publish full street addresses without permission. If you would prefer your property not be used, just email us and we will honor that request.
Text Messages and Communication
By providing your phone number, you agree that we may call or text you about your estimate, appointment, or project. Message and data rates may apply. Message frequency varies. Reply STOP to opt out of text messages or HELP for help. We do not share your mobile number or SMS consent with third parties for their marketing purposes. Opting out of marketing texts does not stop job related communication about active work.
Reviews and User Content
If you post a review on Google, Facebook, Instagram, or another platform, that content is public and governed by that platform’s own terms. We do not offer discounts, payment, or incentives in exchange for positive reviews. If you share photos or comments with us and give us permission to post them, you confirm you own that content and allow us to use it in our marketing.
Intellectual Property
All content on this website, including text, service descriptions, project photos, logos, and design, is owned by Anytyme Outdoor Services and protected by copyright and trademark law. You may not copy, republish, or reuse it for commercial purposes without our written permission.
Third Party Links
Our website may link to other sites, including social media pages, review platforms, suppliers, and partner businesses. We do not control those sites and are not responsible for their content, products, or privacy practices.
Disclaimers
Our website is provided as is. We work hard to keep the information accurate and current, but we do not guarantee that every detail, price reference, or service description is complete or error free at all times.
Nothing on this website is professional engineering, arborist certification, legal, or permitting advice. Complex drainage, structural retaining wall, or grading projects may require a licensed engineer or county permit, and we will tell you if we believe your project does.
Limitation of Liability
To the fullest extent allowed by Maryland law, Anytyme Outdoor Services is not liable for indirect, incidental, or consequential damages arising from your use of this website or our services. Our total liability for any claim related to a project is limited to the amount you paid us for that project.
Nothing in these terms limits liability for gross negligence, willful misconduct, or anything that cannot legally be limited.
Indemnification
You agree to hold Anytyme Outdoor Services harmless from claims, damages, or costs resulting from your breach of these terms, your failure to disclose private underground utilities or hazards, inaccurate property line or ownership information, or your violation of HOA rules, permits, or local ordinances.
Events Outside Our Control
We are not responsible for delays or failure to perform caused by severe weather, storms, snow events, floods, fire, supplier shortages, equipment failure, labor disruption, utility outages, government restrictions, or other events beyond our reasonable control.
Governing Law and Disputes
These terms are governed by the laws of the State of Maryland. Any dispute will be handled in the state or county courts of Montgomery County, Maryland.
Before filing any claim, both sides agree to first try to resolve the issue directly. Most concerns get solved with a phone call, and we would rather fix a problem than argue about one.
Changes to These Terms
We may update these Terms and Conditions as our services, website, or the law changes. Updates take effect when posted, and the “Last Updated” date at the top will change. Continuing to use our website or services after an update means you accept the revised terms.
Severability
If any part of these terms is found unenforceable, the rest stays in full effect.
